Burn Injuries at Restaurants in Texas: What You Need to Know
Flaming fajitas make for an iconic spectacle in restaurants across Texas, but they can present serious risks to customers and workers.
A simple accident can lead to a severe burn injury to you or your child that can cause you to miss work, need surgeries, and other extensive treatment to heal — not to mention the excruciating pain that burn injuries cause.
Even if it seems silly, if you’re burned at a restaurant, as a customer or worker, you should talk to a burn injury lawyer about your situation. You could be entitled to compensation for the losses you suffered.
Why Do Burn Injuries at Restaurants Happen?
There are many factors in any kind of restaurant that can lead to a burn injury. Some of the most common include things like:
- Exposure to open flame — From sparklers/candles, Hibachi grills, flaming food, and other special food service.
- Contact with hot trays or plates — Skillets and hot trays used to serve food with flair can cause extreme burns if customers aren’t properly warned.
- Food spills — Hot food or liquid can cause an especially severe contact burn, especially if grease or boiling liquids are involved.
- Consuming excessively hot foods or drinks — Internal burns can result from eating or drinking food or drinks served at an excessively hot temperature.
What to Do If I’m Burned at a Restaurant?
Most minor burns can be treated by running the affected area under cool (not cold) water. But, if you are burned in any of the following areas, you should seek immediate medical attention:
- Burns to the Face, Mouth, or Throat
- Burns Covering a Wide Surface Area (larger than 3 inches in diameter)
- Burns to the Neck
- Second- or Third-Degree Burns
- Burns to a Joint
If you or your child is severely burned at a restaurant:
- Stop the Burning Process — As quickly as possible, remove any hot liquid or food from the burn area to stop the burning process. Flames should be smothered with a wet cloth or water immediately.
- Call for Medical Help — As soon as the burning process has been stopped, call for EMS.
- Start Basic First Aid — While you wait for help, put the affected area under cool water for 10 minutes (or until EMS arrives). Remove any jewelry or clothing from the affected area unless it is stuck to the skin. Finally, cover the burn loosely with a clean, dry cloth.
For legal purposes, you should take photos and/or video of the burn injury and the scene of the accident. This should be done after seeking medical care, but as quickly as possible.
Can a Restaurant be Legally Responsible for a Burn Injury?
Yes, if a restaurant fails to exercise a reasonable duty of care, it can be held responsible for a burn injury.
Restaurants are required to keep their premises reasonably safe, properly train employees, and have policies in place to protect customers and employees from injury. When they fail to do this, and you are burned as a result, they are responsible for compensating you.
